1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and the operating team of the project "Athirius" ("Athirius", "we", "us", or "our"), an early-stage pre-incorporation tech venture.
By accessing our website, entering your details, and clicking "Join the Waitlist" (or comparable confirmation), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not register for the waitlist.
2. Strict Age Eligibility (18+ Requirement)
The Athirius waitlist is strictly restricted to individuals who are at least eighteen (18) years old or the legal age of majority in their jurisdiction.
Athirius is engineered as an advanced operating system for content creators and online sellers, entailing future contractual engagements, automation tools, and commercial transactions. By registering, you explicitly represent and warrant that you are 18 years of age or older and possess full legal capacity to enter into binding agreements.
3. Scope of the Waitlist Program
The Athirius waitlist is a voluntary, non-monetary pre-launch queue designed to assess user demand, distribute early access entitlements, and communicate development updates.
- No Commercial Guarantee: Registration on the waitlist does not guarantee that Athirius will launch on a specific date, or that any specific feature presented in marketing previews will be included in the production release.
- No Account Pre-Creation: Joining the waitlist does not automatically open a commercial Athirius account, nor does it impose financial obligations or subscription fees upon you.
- Invitation-Only Onboarding: Upon official release, waitlist subscribers will receive an invitation email containing a personalized onboarding link to independently review our commercial terms and configure their credentials.
4. Waitlist Perks & Promotional Benefits
Subscribers may qualify for promotional perks (such as Early Access, Free Credits, 50% Subscription Discounts, Feature Co-creation, and First Access) as described on the landing page:

All waitlist perks are non-transferable, non-assignable, and have zero monetary cash value. Athirius reserves the right to reasonably modify or substitute perk terms if required by commercial, regulatory, or operational necessities.
5. User Representations & Anti-Abuse Rules
When interacting with the Athirius waitlist, you agree to:
- Provide accurate, genuine, and current contact details belonging to you.
- Refrain from utilizing automated scripts, bots, scrapers, or disposable bulk email generators to artificially inflate queue positions.
- Avoid triggering or circumventing security features, including rate limiters, honeypots, or CORS/CSRF headers.
Athirius reserves the right to immediately invalidate and delete any entry detected as fraudulent, automated, or in violation of these Terms without prior notice.
6. Intellectual Property Rights & Feedback License
All software, visual assets, graphics, designs, interactive components, trademarks, and content published by Athirius are the exclusive intellectual property of the Athirius development team and are protected under copyright, trademark, and trade secret laws.
If you submit ideas, feedback, or suggestions through the "Shape Athirius" program or via email, you grant Athirius an irrevocable, perpetual, worldwide, royalty-free license to use, implement, and commercialize such feedback without restriction or obligation of compensation.
7. Disclaimers & "As-Is" Provision
THE ATHIRIUS WAITLIST AND ALL PRE-RELEASE MATERIALS ARE PROVIDED STRICTLY ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATHIRIUS, ITS FOUNDERS, CONTRIBUTORS, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR REPUTATION) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE WAITLIST.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED ZERO UNITED STATES DOLLARS ($0.00) OR THE TOTAL AMOUNT YOU PAID TO ATHIRIUS FOR ACCESS TO THE WAITLIST (WHICH IS NIL).
9. Cancellation & Right to Erasure
You maintain complete autonomy over your waitlist participation. You may cancel your waitlist entry and request the permanent deletion of your data at any time by sending an email to contact@sofianelarbaouri.com with the subject "Remove from Waitlist".
Upon receiving your request, we will permanently purge your record from our database and cancel any associated perks.
10. Governing Law & Dispute Resolution
These Terms, their interpretation, and any disputes arising out of or related to your participation in the Athirius waitlist shall be governed exclusively by the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
You agree that any legal action or proceeding shall be instituted exclusively in the state or federal courts located within the State of Delaware, and you hereby consent to the personal jurisdiction of such courts.
11. Amendments & Severability
We reserve the right to revise or update these Terms at our discretion. Any modifications will become effective immediately upon being posted to this page with an updated "Last Updated" timestamp.
If any provision of these Terms is deemed unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
